Are You or a Loved One Limited by a Disability?

In Tennessee and states all across the United States, people who have disabilities are unfortunately limited in what they can do and where they can go. This is because many buildings such as schools, malls, stores, and even places of work do not provide accessibility or accommodations for disabled people. This is unlawful and the Americans with Disabilities Act or ADA helps to protect the rights of the disabled by not allowing discrimination to occur community places or places of employment. If you or a loved one has been denied access to a community place or denied employment based on a disability, then you should speak to a Tennessee ADA lawyer right away about your legal options and about getting the compensation you deserve.

How is the Americans With Disabilities Act Defined?

This act was created to insure that workers who have a disability get treated fairly and are not discriminated against. This act makes discrimination against disabled people unlawful whether they have a confirmed disability or just seem to be disabled. This act also obligates a company or supervisor to give their disabled workers “reasonable accommodations” so that they can have what they need to do their jobs well. Many people have different understandings about what this act actually means. This is one of the reasons why Congress in 2009 decided to amend the act and the ADA Amendment Act was the result. Disabilities included in these acts are as follows:

  • Disabilities that restrict daily needs (i.e. being able to eat, breathe, hold a job, or walk)
  • Disabled people with written documentation of the disability
  • If a person seems to have a disability
  • Not requiring that your company or supervisor comprehend the condition

What is Required of a Company or Supervisor When They Have a Worker With a Disability?

A company or supervisor who has a worker with a disability is expected to make “reasonable accommodations” available to them to help them be better able to do the work asked of them. A few of these adaptations may include the following:

  • The building and work area being physically manageable
  • Adapted working hours and daily agendas
  • Adapted tools and work area
  • Making specialists available (i.e. people to help interpret or read)

A supervisor is prohibited from insisting on health checkups or other assessments before deciding to hire a worker with a disability or wound.
