Meeting With our Tennessee Probate and Estate Lawyers

If you have been appointed the executor of a will or need our assistance in the probate process we would like for our initial meeting to be informative and beneficial. To ensure that you get an accurate assessment of your legal needs and in order to get the process started as soon as possible it is a good idea to come to the meeting prepared to help your lawyer. As such, we suggest you bring the following to the initial meeting:

  1. Bring a copy of the Death Certificate.
    Although we can start the process without the certificate it will eventually be necessary to have and will provide us with valuable information.
  2. Make a list of assets in the Estate.
    This information is important to know what has to pass through probate, what goes directly to the heirs, what needs to be done to transfer the property and whether the estate is taxable. When making this list we suggest you state: a)how the property is titeled; b) who is named as beneficiary (if the asset is a transferable on death such as life insurance); c) the value of the asset.
  3. Bring the Last Will and Testament or Other Estate Planning Documents
  4. The name and addresses of all beneficiaries in the Will and Next of Kin
    This helps us ensure that we give all notices to potential heirs as is required by law.
  5. List of any debts owed by the decedent; a copy of bills from any creditors.
    The law requires you to give notice to creditors. However, the creditors have a limited time to respond and if they fail to do so the debt is sometimes waived. As such, it is important to get the notice out promptly.
